Abstract

Along with the separation of CHILDren from their parents, CUSTODY issues and priorities of each parent for gaining CHILDren CUSTODY have appeared more seriously than before. Opinions of jurisprudents on priority of parents in gaining CUSTODY are various based on CHILD’s age.This paper utilized a library research. Examining the opinions of jurisprudents and lawyers, some issues including DIVORCE and philosophy in Islam, the causes and effects of DIVORCE and its impact on CHILDren, CUSTODY right, its differentiation with the right of breastfeeding, distance visitation of CHILD, effects of guardianship and its end on lowering police work, have been discussed.
