Abstract

The aim of this article is to illustrate the concept of torture and to examine the position of Islamic Law, as a source of legislation, on this issue. In this survey while considering the effects of religious epistemology on the formation of legal rules, attempt has also been made to study the apparent conflicting views of Islamic Jurisprudents on the issue of prohibition of torture. The conclusion denotes the non-recognition of any form of inhumane treatment and the absence of any legitimacy for torture in the Islamic legal system. The study also shows the invalidity of any confession, statement or behavior made as a result of inhumane treatment in Islamic Law, the rule which can be considered as protecting the wrongdoer's rights against torture.
