Abstract

In a general comparative study of crimes pertaining to breach of trust and embezzlement. we realize that the subject of both crimes is related to property. However, according to law, breach of trust includes both movable and movable properties, while embezzlement relates only to immovable property. Also, breach of trust is essentially a crime against property while embezzlement and its related negative impact has been considered as offences against public order. On a legal basis, criminal act of embezzlement is regarded as "appropriation and withdrawal" while breach of trust can include appropriation, destruction, loss or use of .the property. The legislature has declared the use of property by the employee under another criminal code, namely misappropriation as punishable, and has provided a ruling apart from appropriation in accordance with the statute concerned, regarding it an act of embezzlement and a loss of property, for which no statement is declared. In both crimes, property must have been previously delivered to the offender. However, in embezzlement, submission of property must be related to the individual's profession and duty, while in the breach of trust it must be due to one of the prevalent confidence contracts.
