Abstract

With all the efforts and energy that the thinkers and elites of the Islamic society put in promoting and improving women’s rights in the Islamic Republic of Iran, it is expected from the legislator to review those articles where it seems to be some slight discrimination against women. One of these cases is the CONTINUOUS ABSENCE of the husband described by article 1029 of the Iranian civil law as follow: "If a man has been for four years continuously absent with unknown whereabouts, his wife can apply for a DIVORCE […]". Therefore in this research we will discuss the conditions and impacts of the CONTINUOUS ABSENCE of the husband from different point views of Islamic jurists and lawyers who consider it as a case of HARDSHIP for wife and will further conclude that the duration of 4 years mentioned in the above article should be flexible to be decreased, finally we propose some suggestions for the revision of relevant laws and regulations. french: L'absence du mari comme exemple pour les difficultes de l'epouse (une critique sur article 1029 du Code Civil) Avec tous les efforts et energie que les penseurs et les elites de la societe islamique mise en favorisant et en ameliorant les droits des femmes dans la Republique Islamique de l' Iran, on s' attend que les legislateurs passent enrevue certains articles ou il semble etre une sorte de discrimination contre les femmes. L’un de ces cas est l' absence continue du mari decrites par l' article 1029 du code Civil iranien comme suivent: «Si un homme a ete absent, sans interruption, pendant quatre annees, avec le lieu de sejour inconnu, son epouse peut solliciter un DIVORCE […] ».Par consequent dans cette recherche nous discuterons les conditions et les impacts de l' absence continue du mari de differentes vues de point des juristes et des avocats islamiques qui la considerent comme cas des difficultes pour l' epouse, et conclurons plus loin que la duree de 4 ans mentionnes dans l' article ci-dessus devrait etre flexible a fin d’etre diminuee, finalement nous proposons quelques suggestions pour la revision des lois et des reglements a ce propos.key word: DIVORCEz, absence continue, difficultes, entretien, non-difficultes spanish: la situacion de la mujer en la ausencia del marido (comentarios sobre articulo 1029 de la ley civil) Con todo el esfuerzo que se lleva a cabo por los pensadores y las elites de la sociedad islamica para mejorar la situacion de la mujer en la Republica Islamica de Iran que espera que se revisen algunas normas actuales que son una injusticia para los derechos de las mujeres. Uno de estos casos es el tema del abandono de su marido que en el estado actual el legislador se refiere a la esposa del articulo 1029 de la ley civil. En virtud del presente articulo si el marido esta ausente su esposa deben esperar 4 anos. A continuacion, puede pedir el divorcio al considerar los rituales especiales para los que se decidio este articulo, considerando las condiciones y los resultados de que su marido esta ausente y perdido en el punto de vista de los juristas islamicos y los abogados llegan a la conclusion de que de que estos 4 anos se debe disminuir y en el final de este articulo se le ha dado algunas sugerencias para la correccion de las normas pertinentes.key word: divorcio, estar ausente y perdido, la pension alimenticia, dificultades, el mantenimiento, facilidad
