Abstract

THE WISE PROCEDURE as an expert term in the Jurisprudence and relating principles indicates the method and manner of the wise when they embark upon or abstain an affair apart from the intervention and effects of time, space, religion, race and group factors. The CUSTOM of the wise always and in every society has been considered and regarded as a criterion in practice and the sacred religious law of Islam has also endorsed many of the wise practices at that time. THE WISE PROCEDURE, always and nearly from the beginning time of the Shiite Feghah has been focused by the Foghaha and continuously played creative role. However, it seems that most of the capacities of this institution, in solving the political, economic, cultural and international problems have not yet been exploited. The article intends, while introducing shortly THE WISE PROCEDURE and its functions, studies the Shiite thinkers ideas relating to the religious validity of wise manners.
