Abstract

PRISON and ImPRISONment were not regarded legally during pre-Islamic Iran, and punishing the condemned was not significant legally and politically, however, there are some historical references and texts that show imPRISONment of some princes and kingship claims and also imPRISONment of Manichaean s and Mazdak s followers during the Sassanid period. Although, during Islamic period and at the time of Mohammad the Muslim s prophet- and the first four caliphs, imPRISONment and PRISON had not penal significance, there are many documents in Quran and Sunnah that shows the legality of imPRISONment, PRISON and PRISONer. But Umayyad period might be the beginning of missing legal significance for imPRISONment and PRISON and it changed to torture the PRISONers.From that time, the correctional and training significance of imPRISONment was ignored, and it continued during Abbasid period. Increasing the number of PRISONs was not the meaning of their improvement, and their subsisting environment was bloody critical in addition to PRISONers torment. Under this condition, some limited measurements were done by government and rich men to improve the hearth-breaking conditions of PRISONs that were helpful to ameliorate the PRISONs just for a short time during the EARLY ISLAMIC CENTURIES.This article is aimed to review the history of PRISON, its derived definitions from preIslamic ages to the end of Abbasid period, existing conditions of the PRISONs during that time, considering derived religious and legal matters of PRISONs historically.
