Abstract

Based on the contents of jurisprudential literature, two theories can be deduced concerning DECRIMINALIZATION of using SOFT DRUGS. The first groups contains the opponents of the issue. Opponents believe that prohibition of using SOFT DRUGS can be considered firstly as the prohibition of endangering one self and then prohibition of endangering one soul for each of which, there are a lot of documents in the holy Qur’an traditions and intellectual bases. On the other hand, some jurists believe that human governs himself or herself and inflicting a lot of harm arisen from using SOFT DRUGS contains our exit from what we own. To the authors of the present article using all kinds of narcotic drugs is prohibited due to its harm on the health and because in one hand, the arguments concerning prohibition of narcotic drugs are very vigorous, and on the other, the arguments for such usage are not vigorous enough. It may be argued that using SOFT DRUGS is permitted in certain circumstances their special features which specify them from other kinds of narcotic drugs based on the advocates’ opinions. They argue that the subjects will exit from the argumentation of inflicting harm.
