Abstract

Due to a change in the science of law as in other sciences, the present phase of Law studies is interpreted as "Scientific reasons", the purpose of which is applying the achievements of science and technology such as DNA testing, in the process of CRIME DETECTION and criminal proceedings. Hence it is necessary to discuss them from an Islamic criminal jurisprudence perspective to determine the legitimacy of their application, credit and lack of credibility. Evidence has relevancy regarding the crimes offensive to the right of God”. Therefore they cannot be proved by scientific reasons and methods. However, suspects of doing this type of crime can be exonerated using the method of scientific reasons and creating doubts. But in realizing the right of people and its importance for the religious lawmaker, scientific methods can be used. since the evidence in such matters has “Principality” and serves the realization of the right of people, judge can use all Capacities including the scientific method for proving the crime. This will pave the way for securing of the Social Rights, which in itself guarantees the security of the society.
