Abstract

on the pretext of challenging the content of article 268 of the Islamic Penal Law, this essay intends to legally examine the issue of the MURDERed person’s optipn to retaliate or pardon prior to being killed. Upon examination of the views of great imami and Sunni jurists and accurate evaluation of their arguments, it is concluded that in deliberate MURDER the right to retaliate, BLOOD MONEY, pardon, and financial compromise are the primary and original rights belonging to the avengers of blood and the MURDERed person has no right in this respect, except for what is specifically related under the rubric of fulfilling the obligations and last wills of the MURDERed person on the credit of the BLOOD MONEY.This writing is also examining, in the course of criticism of the proofs, such issues as damage to self and the physician's exemption from liability before medical treatment.
