Abstract

The issue of Hoarding/fa?page=1&sort=1&ftyp=all&fgrp=all&fyrs=all" target="_blank">Drug Hoarding, which is done with the goal of expensive selling or harm to society, is significant, due to the vital role and direct relationship of the drug to human health, but no independent research has been conducted on its dimensions and religious considerations. Therefore, the present research seeks to explain the relevant religious rule by analyzing the relevant verses and narrations and the feasibility of generalizing the religious arguments of Hoarding, to warehousing and non-distribution of drug, and to review the current laws governing it. The research is practical in terms of purpose and descriptive-analytical in terms of method. In collecting data and information, the library and documentary method used and the analysis of information obtained from narrative, Qur'anic and jurisprudential and legal sources have been qualitative and based on the researchers' conclusions. Based on the findings of the research, Quranic and narrative sources show that the criterion in the religious prohibition of Hoarding was the need of people for stored goods, and the general meaning of "food" mentioned in some narrations includes warehousing and non-distribution of required drugs. In addition, La Zarar [no loss] rule, as a general reason, is another document on the sanctity of Hoarding/fa?page=1&sort=1&ftyp=all&fgrp=all&fyrs=all" target="_blank">Drug Hoarding, and because of its rule over Taslit (absolute legal power to private property) rule, the owner of the drug is obliged to supply and distribute it, and if he refuses, the head of the Islamic government will do so on his behalf. Also, according to the rules of criminal jurisprudence, the drug Hoarder is deserved to be punished and the amount is determined by the head of the Islamic government.
