The Mothers' Right from the Viewpoint of Imam Sajad and International Law

Abstract

 Nowadays, the international law pays special attention to the mothers' right due to the non-binding resolutions of United Nations General Assembly. The concept and examples of this right, in the form of women's and mothers' rights, have been emphasized much more accurately in Islam, particularly, in the thoughts of Imam Sajad. This research explains the mothers' right with the help of Islam and international law. According to the Hohfeld's classification, from the viewpoint of international law, the most mothers' right is liberty; but from the Islamic view, it is very greater and it is the right to claim. In terms of time span, the international law limits the mothers' right to the pregnancy period and its complications and recognizes the right to the upbringing of the children as a parents' right, of course, with some constraints; but from the Islamic perspective, especially in the thoughts of Imam Sajad, not only is the mothers' right not limited to the pregnancy period, but it also continues till their death and the government, husband, international law, resolutions of United Nations General Assembly, and children should observe this right. Therefore, in Islam, the mothers' right is much more complete and progressive than what is in the international law and it is necessity for the international law to take advantage of Islamic teachings.
