Abstract

Transferring ownership of assets to the host is one of the raised issues in upstream oil and gas contracts. Through time, transferring ownership of oil equipment and installations were considered as a proviso, but this is still controversial because proviso has not independence. By using content analysis method, countries' approach to the transfer of ownership of project assets was analyzed. Investigating some of these contracts in the realm of upstream oil industry, the results indicate that contracts for implementing oil operation do not show homogeneous approach toward alienation transferring of oil equipment and installation. Even in homogeneous contracting model they do not observe the same method; so awareness of these functions in different situations can be found the best time and ways of transferring ownership and third parties rights, rental property and Unused Property status.
