Abstract

After the approval and full support of ROME STATUTE by almost tow third of world community members in last decade of twentieth century in Rome Italy, waves of hopes and fears in fighting against impunity; immunity for core crimes and exercising justice for all human beings covered all related academies and global civil societies. The ICC proponents with strong support of world civil societies( NGOs and IOMs and etc..) hoped to end global barbarities like the trauma of former Yugoslavia and Rwanda in the past and Darfur of Sudan and Libya and Israel. In contrast, some THEORETICAL AND PHILOSOPHICAL CHALLENGES cause hesitation about the court success to meet the expectations of international community. The main goal of this article is analyzing the major challenges on this aspect to evaluate their reality and effectiveness.
