For the growing of information technology. Protection of patient`s Privacy in cyberspace has become one of the main matters of medical law. To this end. The rules are set out in international documents including the right to choose beneficiaries at the information gathering stage. Observance of data security. transparency and access to data and accuracy in data retention. The necessity of related processing and the prohibition of disclosure of data at the stage of information use and finally. the need to eliminate or prohibit transboundary data transfer at the end of the patient status process, however the constitution and some of laws emphasize to Privacy and non-disclosure of patients but E-commerce law and cybercrime law generally refer to the protection of such information and without regard to the above sequence and order. Merely refer to the principles of subject satisfaction. Legal collection. as well as data dilatation. The principle of data accuracy and their elimination. Before applying big data technology to mass applications and applications, a basic issue called Privacy must be explored.

Opponents of protection of Privacy are so interested in acquiring, processing, and even commercializing individual data. This act, even if it is accompanied upon permission of the individual, will endanger personality and individual and social security of the person and his Privacy. Thus, one of the main questions in the field of Privacy concerns the extent of persons' rights and the extent their wills may influence Privacy and possibility of assigning or relinquishing it in relations between individuals. The reply depends on whether Privacy is a "right" or an "award". If it is an award, then a person cannot compositionally intervene in assigning or relinquishing it; though it seems possible by applying creative will. The aspects of the Privacy related to human dignity, personality and spiritual prestige of the person being subject to Privacy, are assumed as "awards" but aspects not related to the above which if disclosed will not harm persons' spiritual prestige are "rights" and may be considered as property and assigned or relinquished if necessary.

Mankind has two dimensions. On the one hand, he could be regarded as an autonomous being and on the other hand, he could be seen as a social specy that lives and communicates with other human species. These dimensions are not separatable and the society must be accepting his autonomy and its requirements. This autonomy entitles the mankind to have some special rights to his spiritual and corporal integrity, which is called "the right to Privacy" that deters the others from interfering. He/she expects the law, as a system of organizing the structure of the society to provide some protections for his/her Privacy. In some legal systems these protections are weak and in some others they are enough. Iranian legal system including Constitution and Statutes has provided some weak protections to this Privacy. The Constitution, has not referred explicitly to this right, protections are not enough and it needs to pay more attention to this right. Whereas, Iran has ratified some international conventions that ask the governments to protect and respect the right to Privacy, this right is not well known in our legal system. In present Article, in the first part, the notion of the right to Privacy, regarding to the international conventions and the legal system of some countries, is reviewed. The notion of the owners of this right is also considered. In the second part, the samples of this right are being considered with a critical analysis in Iranian legal system.  

As we know information technology has a special role in the organization and retrieval of information to such a huge extent that was almost impossible before. This may entail interest and loss. This article attempts to answer two questions: what is the definition of Privacy? And In which cases respect for Privacy is necessary? Discussing about the concept of ‘Privacy’, the paper presents a value-judgment on disclosure of Privacy information with regard to Islamic values. Then it points out that one action may be known as being under several titles; so, there can be independent value-judgment in terms of each title. The Next point is that sometimes the value of Privacy is in antithesis to the value of institutional purposes; in such a case, solving the conflict should be done according to priority of values in the teaching of Islam.

Background & Objective: patients’ Privacy is a very importance variable that effects patient satisfaction and their perception of quality of care. However, most of studies in this area were conducted in emergency units and among non-older age groups. The aim of this study was to evaluate the elderly patients’ perceptions of their Privacy and their satisfaction in selected hospitals in Esfahan.Methods: This cross-sectional survey was conducted on 330 elderly inpatients in selected hospitals in Esfahan and Kashan cities that were selected conveniently. Data were collected using the patients’ Privacy and satisfaction questionnaire that was previously validated and was reliable (Cronbach's alpha 0.84). The data were analyzed using descriptive statistics, Kruskal-Wallis, Mann-Whitney U and Spearman correlation testes.Results: The overall Privacy mean score was in poor level at 15.2% of cases. It was at moderate and good levels in 68.5% and 16.4% of cases, respectively. The Privacy was at moderate level in physical dimensions (64.2%), information dimensions (70%) and psychosocial dimensions (72.7%). In total, patients’ satisfaction was at moderate level in all dimensions of Privacy.Conclusion: The present study showed that elderly patients’ Privacy was being observed at moderate level in most of domain. Consequently, the elderly patients’ satisfaction was also at moderate level. It is therefore necessary to pay more attention in the elderly patients’ Privacy.
