Abstract

Prohibitive PUNISHMENTs are among the utalitarianistic mechanisms in criminal justice.It is believed that humans can be prohibited from the results of some of their acts when threatened. Such results are known as PUNISHMENTs in the criminal law. The question is wether PUNISHMENT can act as a prohibitive mechanism or not Whom does PUNISHMENT threaten? The present paper tries to answer these questions.The results showed that in order for the PUNISHMENT to work as prohibitive, several different conditions must be present.
