Abstract

Article 83 of the Constitution is one of the principles for which supplementary laws and regulations have not been approved so far, and its definition and measurement criteria are still unclear. According to this principle, government buildings and properties that are in the category of National treasures cannot be transferred without the opinion of the Islamic Council. The administrators of cultural heritage affairs have made decisions about it in three ways: empirical, consensus and relying on world records. The decisions made about these treasures due to the lack of a proper recognition and transfer mechanism can cause the destruction of the original or a part of the works. The theoretical approach of defining the concept of cultural heritage is the criteria for recognizing national excellence. This qualitative study made it possible to answer the research questions by using document studies, interviews and snowball sampling method after conducting 21 interviews and using the details of the parliament's deliberations on Article 83. This research made a conclusion regarding the definition of national beauty and unique beauty and suggested that in order to recognize national beauty, inter-agency committees should be formed in order to provide a basis for decision-making without orientation and conflict of interests. Also, the scope of Article 83 of the Constitution should be extended to non-governmental property and protection of the owners of these treasures or the purchase of National treasures by the government.
