Civil liability arising from the use of artificial intelligence-based naval military systems in different maritime areas with emphasis on challenges and gaps

Abstract

Artificial Intelligence has emerged as a reality with the advent of the fourth industrial revolution, especially in naval military science. Naval Military Systems based on Artificial Intelligence have various applications from data collection to military calculations and decision making. Also, Artificial Intelligence systems have increased the capability of self-control, regulation and automatic military action in cases of naval attacks. Artificial Intelligence systems are used in almost every naval application today. However, all the applications of Naval Military Systems based on Artificial Intelligence cannot be immune from problems, and therefore, issues related to civil liability arising from the use of these systems have been raised. In this regard, challenges such as the exercise of sovereignty are also raised, which according to Article 9 of the Civil Liability Law of 1339 is one of the exceptions to civil liability. The main question in this article, which has been done in a descriptive-analytical way, is that the civil liability resulting from the use of Artificial Intelligence-based Naval Military Systems in different Maritime Areas can be analyzed from the perspective of Iran's legal system. In response to this question, it should be said that two categories of actions are conceivable for these systems, meaning that if they are in the position of exercising sovereignty and damage is caused to individuals, based on Article 9 of the Civil Liability Law, there is no responsibility towards the naval armed forces. And if there are tenure practices, this Civil Responsibility is assignable
