Abstract

Although the prohibition of the WINE is unanimous, there is disagreement about the quality of its prohibition. Some Shiite scholars date back its proclamation to the early Mecca, but the Sunni date back to the late period of the Medina and believed that its prohibition was gradual. So the theory of GRADUAL BANNING has been given. This study is a critique of this theory. This theory has some fields and outcomes that will be referred to in this research and then rejects the gradualist in banning and proves that the proclamation of the banning WINE relates to the early Medina. And finally, the gradual is in implementation of the punishment for WINE drinking not in proclamation of its banning.
