Abstract

The crime of ADULTERY in Islamic Shi' i jurisprudence is a crime. After the Islamic Revolution of 1979 in Iran, IRANIAN LAW, especially criminal law based on SHIITE JURISPRUDENCE, has been established. In the years after the Revolution, the criminal laws concerning the Islamic limits, especially the crime of ADULTERY, were reviewed. In the present article, the purpose of the rights of a person is the rights of the perpetrators of ADULTERY in the stages of discovery, pursuit, investigation, investigation. In this paper, using the library study method and the current laws of the Islamic Penal Code approved by the Criminal Procedure Code of 1392 and the analysis of the rights of the accused person to commit ADULTERY in Shia jurisprudence and Iranian judicial law and their implementation, That the moghānn in 1392 and the Islamic Penal Code and the Criminal Procedure Code in 2013 have fully complied with the principles and rules of SHIITE JURISPRUDENCE.
