Feasibility of Guilt Criminalization (Disruptive to Order, Security and Public Ethics) From the Point of Views of Seminary and Legal elites

Abstract

 Background and Objective: In Article 638 of the Islamic Penal Code, the legislator, without specifying a specific criterion or measure, attempted to criminalize the pretense of practicing haram, which, in addition to opposing the rule of the Bible's Eagle, could cover a wide range of types of suffering. Therefore, in the present study, the scope of the Criminality of certain types of Guilt, in particular, conflicts with Security and general ethics from the point of view of the Legal and Legal Elites has been discussed. Method: This is a post-event descriptive study. The sample was selected from among the two groups of Legal and semi-Elite Elites, and each of them, 60, was selected by available method. The research instrument consisted of a researcher-made questionnaire whose reliability was determined using the Cronbach's Alpha coefficient of 0. 72 and the validity was based on the views of the Elite and the experts, both formally and contently. T-test was used to analyze the statistical data. Findings: The dominant Elites have emphasized on the lack of censorship only in high-level relatives (t =-0. 185, p <0. 01) and low (t =-0. 134, p <0. 01), and the Legal Elites also emphasized the lack of censorship in (3. 25% t-value, p <0. 01) and low (t =-0. 979, p = 0. 019), respectively. Conclusion: The results showed that on the contrary, in the case of large-scale criminalization, only Legal and semi-Legal Elites emphasize the serious criminalization of the disorderly discipline, Security and public morality as the crime of pretending to act haram in public.
