Abstract

prosecutors in Iran and the United States are prosecuting general charges against the accused. Police also play an essential role in the criminal justice system in both countries, as they carry out a large part of criminal investigations. The two officials in both countries are required to defend the community's order and security simultaneously, including the rights of the accused, including the defendant. The interaction of these two official agents affects the balance between the social order and the rights of the accused. This interaction takes place in a variety of ways. On the one hand, in order to maintain social order and security, the prosecutor and the Police, together with a large proportion of the investigations, are doing so they can be considered members of a team. The prosecutor also has a map of the presidency of the Police officers. Performing these tasks in order to maintain order and social security. On the other hand, the prosecutor has the right to supervise the Police for use. The prosecutor also has the duty to respond to the Police in case of misconduct in order to protect the rights of the accused. In this paper, the interaction of these two official agents with a view to balancing the protection of social rights and the rights of the accused has been examined in a comparative manner.
