Abstract

In order to achieve the objectives of procurement regulations, legislative bodies, design procedures for conducting public sectors procurement and have obliged public sector entities to comply with them. For this reason, the design of methods appropriate to the various market conditions and its requirements is an essential issue of Tenders Laws. The results of the “ comparative study” of the UNCITRAL Model Law on Public Procurement 2011 and Iran’ s Tender Law 2005 confirm that there is a lack of dynamism, coherence and agile in the implementation of the bidding process in the methods of holding Tenders expressed in the Iranian legal system, despite observing some general principles and objectives of tender rights, and it seems that, one of the main reasons for this is the inconsistency of the mechanism in the implementation of these methods with developments in the last decade, especially in the field of communications and digital technologies. The existence of this shortcoming has doubled the importance of the needs to review the procedures for holding Tenders contained in the Iran’ s law, in order to increase the capability and effectiveness of the law and in terms of application, to meet today’ s needs and requirements of international trade.
