Abstract

One of the components and Factors at work in sleeping partnerships with a bank is profit. According to jurisprudents the exact amount of profit can not be determined in sleeping partnerships with banks, and in case it is determined in advance, the contract of this kind of partnership would not be legitimate and the transaction would be considered as usury. In view of the fact that specifying the profit in sleeping partnerships with banks will render it illegitimate and considering article number 21 of the fifth chapter of the non-usury deeds of banks which reads as: "The central bank or any other bank are not permitted to enter any act of usury with each other" The question arises that whether in such partnerships with banks, actually the amount of profit is not predetermined? Could it truly be claimed that in these types of transactions there is no usury unvalued? If as a result of this kind of transaction, the agent looses and earns no profit, will the bank accept the responsibility and compensate for the losses incurred? And finally in such partnerships is it right to place the agent under the condition of liability or not? The present article studies the issue of "profit" in the sleeping partnerships with banks and in so doing utilizes jurisprudence and legal underpinnings in order to shed some light on these questions.
