Abstract

TRADE SECRETS Law is an issue which in one hand relates to Intellectual Property Law and in the other hand to Competition Law and by its very nature is within the framework of Information Law.Depending on the circumstances and kind of relationship between the owner of CONFIDENTIAL INFORMATION and the others, protection of TRADE SECRETS is made by different ways which the most common one is use of RESTRICTIVE AGREEMENTs and specially most important ones, i.e Noncompete, Nonsolicitation and NONDISCLOSURE AGREEMENTS.Having clarified the notion of TRADE SECRETS, this article will embark on analyzing the definition, validity conditions and method of protecting of TRADE SECRETS by RESTRICTIVE AGREEMENTs in American, English, French and Iranian Law.
