Abstract

 The acceptance of minimum rights for aliens in the states practice as well as in international documents about human rights, is indebted to the developments occurred in international relations in recent centuries. It is also affected by relations between individuals and foreign states.The most important rights for residing state include: admission of aliens, expulsion of aliens and also extradition of criminals, implemented by each state according to its national interests and within the framework of international law.That state is bound to protect and support the aliens and where an alien is injured or damaged due to an act or forbearance by administrative, judicial and law-making organs contrary to international law, the responsibility is upon the residing state.In recourse to international documents about human rights and states practice, different rights can be drawn for aliens, including: right of living, personal freedom and security, right of pleading for justice in due courts, avoidance of any torture or humiliating behaviors, right of marriage and protection of the family, rights of ownership and education.In case of violation of aliens' rights by the residing state, diplomatic protection is taken into account.Foreign citizens, in turn, must observe rules and regulations of the residing state; otherwise, they may be punished according to the crimes they have committed.Enjoyment of basic rights and freedoms by aliens requires codification and approval of a general international treaty related to their rights and duties that assures more effective application of it in the international community.
