Abstract

Accident and health INSURANCE is a kind of personal INSURANCE. Some questions arise about the above-mentioned INSURANCE due to its spread and diversity. One of the most important questions is about describing the legal nature and treatment of accident and health INSURANCE contract. This article scrutinizes existing theories and the nature, pillars, features and description of these contracts. Accident and health INSURANCE contracts are other than mentioned contracts of civil law. Due to status and role of third party, three types of third party commitments with different legal natures exist. Accident and health INSURANCE contracts have both required and prohibited descriptions, simultaneously and a bilateral, definite, continuity and ceremonial contract. Also, it has possible and circumstantial conditions.
