Abstract

Considering that the majority of legal issues of the maritime insurance depend on the maritime law, properties which are covered by the maritime insurance and the risks and losses are insured as a common subject which are as followed: goods, ship, etc. Conditions and cases in this study are examined with regard to insurance issues. Conditions like probability, dispersion, multiplicity, randomity, similarities and uniformity of risks for insured are considered as substantive and common conditions. And conditions like being known and determinable and being at risk and legitimate are considered as formal conditions. However, it seems that it is possible to answer some of the issues related to maritime insurance using the available judicial procedure and general conditions of insurance policies such as conditions A, B, and C, and the available conventions; but, it is necessary to have a comprehensive and preventive law on maritime transportation insurance that cover the damages to the products being shipped. Accordingly, the present study is to review and evaluate various aspects of maritime transportation insurance including nature, characteristics, terms and conditions of the parties, and obligations and responsibilities of insurer and insured and then uses the findings to analyze the maritime insurance laws of Iran (1964) and the maritime insurance laws of England (1601).
