Abstract

The purpose of this descriptive and content analysis study is to investigate the theological validity of virtual divorce occurs in cyberspace, whether by email, SMS or other means of mass communication. Research data were collected by the library and documentary method. Shia clerics disagree about whether the validity of a virtual divorce. Some believe that although Written Divorce is valid under certain conditions, such divorces are invalid in accordance with the laws of shri’ ah and the norms of an Islamic lifestyle, and also due to the possibility of deceit, failure to ascertain the Willingness of the parties, the promotion of anarchy in the society, and the destruction of the foundation of family. On the other hand some advocate the validity of such divorces by citing the verses in the scripture and hadiths concerning the laws of divorce, invoking their similarity with the written and unintentional divorce. Similar to a person's confession in the presence of the judge, the submission of an email containing registered electronic signature, provided that the conditions of the divorce are met, this could be considered a manifestation of their Will to divorce. According to this research, the theory of the proponents seems to be preferable, given the conditions, due to the strength of the arguments, the consistency with the general demands and the requirements of the present era.
