Abstract

The influence of celebrities and the role of scientific, cultural, political figures, etc. on public opinion and their direction, especially by using the capacities of cyberspace and the media, is one of the important and controversial issues that is sometimes considered a threat to social security and public order today. The emergence of manifestations of this influence and role-playing in the fall of 1401 AH and the subsequent bitter events caused some members of the Parliament prepare and present a plan in the winter of that year to confront and prevent the negative roles played by famous people (celebrities) and influential figures, which became known as the "Punishment of Individuals over Expressing Opinions" plan. This article, adopting a descriptive-analytical method, criticizes and examines the plan to punish individuals for expressing opinions from the perspective of the general policies of the Islamic Republic of Iran and the principles and standards of criminal law. It proves that the aforementioned plan is inconsistent with the general policies of the system in the field of decriminalization and de-imprisonment, violates the principle of quality improvement of criminal laws and the rules of the chapter on causation, and lacks comprehensiveness.
