Abstract

In this paper, Essence of Jurist’s GUARDIANSHIP and it’s position in forming and continuing of Eslamic Government is studied. The Writer by virtue of denotion of Quranic Verses and Traditions and based on Rational Reasons, has proved The basic position of GUARDIANSHIP of Jurist about formation of Eslamic Government and Executing of all of theological laws in The Time of disappearance of Emam (blessing of god be upon him)In a word, Prophethood of the Holy prophet was the main cause of appearance of Eslamic Government and being of Holy Emams after prophet until martyrdom of Emam askari (The eleventh emam), is cause of continuation of Eslam and Eslamic Government, this great responsibility in the time of disappearance of Holy Emam became the main duty of The Jurists how have The necessary qualifications. therfore, GUARDIANSHIP and Government of Jurist is The only way that prevents from vacation of Islamic laws.
