Abstract

Generally, creation of all human conducts are not spontaneous generation, rather, these conducts are firstly designed in the Mind and in the event that he decides to behave the same as is in mind, he will act after preparing the priliminaries. Crime, as one of these conducts in not excluded from the above principle. The guestion that here arises is whether or not all the above phases full with the criminal prosecution or only defined situation fall within it. With regard to this guestion it should be noted that the criminal law intervenes only in the phase of Execution acts not before that. Therefore the phase of Preparatory act, with few exceptions will not be panisheble at all, and it is accepted as principle in all legal systems. The NOTA BENA (NB) of Article 41 of the Islamic criminal law comprises the principle, but Article 664 of the abave law appears to contradict with the principle. In this Article, however the autners try to realise the preparatory acts, their specitications and the theories concerned. In the end the probable controversy betwen the Articles will be carefully considered.
