Abstract

Experts of the principles of jurisprudence have for a long time been interested in different types of injunctions and their obligatory divisions, yet the distinction between guidance and PATRONAGE INJUNCTIONs is relatively recent in the principles of shi’ite jurisprudence. In regards to sunnites, for the reasons recounted in the present article, the distinction is not significant. The reasons for the importance of distinguishing the GUIDANCE INJUNCTIONs from those of patronage lies in the fact that the PATRONAGE INJUNCTIONs have a compositional characteristic and require independent SUBMISSION, whereas the GUIDANCE INJUNCTIONs have a declarative nature and by implication suggest that the action in question is recommended and therefore akiding by it or not doing so does not result in a separate recompensation or retribution. The next point to remember is that there is no unanimous agreement among jurisprudents regarding the criteria for distinguishing guidance in junctions from the patronage ones. The present article is the result of an attempt to offer a critical survey of different viewpoint in this regard and to offer a feasible solution to the problem at hand and to advert to those principles of jurisprudence which somehow or the other have a bearing on the guidance and PATRONAGE INJUNCTIONs.
