Abstract

The Marriage of the MISSED HUSBAND'S WIFE has been the subject of the Imamiyyah jurists' jurisprudential studies.Our purpose in this text is to study of the well - known view on the necessity of patience and waiting, and also to consider the non-allowance of issuing a DIVORCE decree by a judge when there is an alimony. Here we try to show that the issuing of DIVORCE of such a woman not only is not in contradiction with Islamic laws, but also it is extracted from recommendations of the non - fallible household of the Prophet Mohammad (peace be upon him).
