Abstract

The rapid developments in medical studies have created some challenges in some areas such as artificial insemination, transplant, etc. One of these challenges relates to legal issues of transsexual people affecting all regulations particularly famaily law area. there are some forgotten and unseen aspects in the statutory laws. One of the questions in this regard relates to the effect of sex reassignment surgery (SRS) on the crimes committed prior to this evolution and how it can effects to the issued punishments. This article is to study the effect of sexual transition on some crimes like marriage with an immature girl, Fraud in Marriage, and desertion. It seems that the parliament should pay more attention to such matters specially regarding to the public order and public interests, although before that on the basis of legality and its consequences, and according to some reasonable doubts, the punishment should be dismissed.
