Abstract

CAUTION has an important role in abolition of CIVIL LIABILITY, because if it is done timely, properly and effectively in dangerous situations and in possible incidents, but the injured person does not pay attention to and subsequently a harm and damage occurs to him, he cannot consider doer, who has warned, as liable and cannot held the claim to compensation vs. doer.One of the most important scopes of the effect of CAUTION is MEDICAL LIABILITY. Majority of medical personnel, sometimes, express WARNINGs to medicines and services would have been taken properly with paying attention to them. Such WARNINGs can be considered as a proper defense in contrary of CIVIL LIABILITY if they have required conditions. But the basic question is what are CAUTION and its conditions, jurisprudence foundations and impact scope? In the light of the answering to the question, the possibility and scope of utilizing it in our legal system can be provided clearly.Therefore, this paper attempts to analyze the question in three sections. Firstly, the nature and conditions of CAUTION are explained. The second section is allocated about the role of the effect of CAUTION in CIVIL LIABILITY in legal perspectives. And in the third section, the impact of CAUTION has been studied in view point of Islamic jurisprudence.
