Abstract

Active VOLUNTARY EUTHANASIA as a sort of EUTHANASIA is one of novel questions in Medical law and Islamic jurisprudence which result to the death of patient in the nature by patient’s PERMISSION. There are two main opinions about it in the Islamic Criminal Jurisprudence which are relied on the victim’s PERMISSION and provisions of EUTHANASIA. The most famous view is based on falling punishment from murderer and the other view emphasis on the punishment. In this study after explanation of position of PERMISSION in the legitimacy of ACTIVE VOLUNTARY EUTHANASIA, theoretically, the view of confirmation of punishment has been selected, and in practice, for precaution, the view of compromise on blood money has been selected.
