Abstract

DURESS in one of the secondary titles which removes the prohibition of a permitted behaviour and its punishment and in fact, conducting that act will become permitted. DURESS is defined as a situation getting ride of which necessitates committing a prohibited conduct. One of the subjects concerning DURESS in jurisprudential issue is therapy of INFERTILITY. If INFERTILITY of the couples make so much difficulty whose therapy is realized as essential, commission of some preliminary behaviours which are prohibited based on a secondary rule such as looking at or touching will become permitted. This research deals with the status of the principle of DURESS in the therapy of INFERTILITY.
