Abstract

REQUIREMENT OF FERTILITY or Ignoring such a requirement has not been clearly expressed in Iranian Acts. Neither had it been discussed in Jurisprudential texts, nor had a decision been made about it definitely.Nevertheless, jurist’s different viewpoints concerning fertility and its status in MATRIMONY have been diversely discussed under some titles such as: “reluctance of dismissal without a requirement and a wife’s satisfaction in permanent contract” and “permitted defects of cancellation of contract. The author of the present article tries to find answers foe some challenging jurisprudential questions which have obsessed jurists’ mind for a long time. Issues including STIPULATION or lack of such a requirement, obligations arisen from MATRIMONY, legitimacy and indispensability of fertility based on the verses of the holy Qur’an and jurists’ opinions will be discussed. Furthermore, the author highlights distinctive features by categorizing the opinions into those of opponents and those of advocates. Discussions and criticisms concerning presented opinions have been presented based on the verses of the holy Qur’an and jurist’s opinions.
