Abstract

 GERMAN: Oft wird angenommen, dass Iğtihād von Schiiten praktiziert wird und dass dieTore des Iğtihād im sunnitischen Islam verschlossen sind. Neuere Forschungenhaben letzteren Teil dieser Annahme hinterfragt. Allerdings wurde bislang dieGeschichte des Iğtihād im Schiismus nur wenig untersucht. Dieses Kapitelbehandelt die Entwicklung und graduelle Entfaltung des Iğtihād im Schiismusdurch schiitische Juristen. Es wird sich zeigen, dass die meisten der frühenschiitischen Juristen Iğtihād ablehnten, und dass sowohl das Vakuum, das durchdie Verborgenheit des Imams hervorgerufen wurde, als auch die Notwendigkeit,auf die zunehmenden Bedürfnisse der Gemeinschaft einzugehen, die Juristenzwang Prinzipien des Iğtihād im schiitischen Islam aufzunehmen. ENGLISH: New issues and contingencies have forced Muslim jurists to engage in freshscholarly research and iğtihād, so as to order to provide timely and relevantguidance to their followers. This paper will initially examine the argumentsof various contemporary Muslim thinkers who call for a re-evaluation oftraditional iğtihād and devising new strategies for a new form of iğtihād.These scholars have also called for a rethinking of the epistemological basisand hermeneutical tools inherent in Islamic legal theory (Uṣūl al-Fiqh).Jurists who argue for the renewal of iğtihād, also maintain that theinterpretations of Islamic revelation were interwoven to the specificity ofthose times and places. Jurists can only pronounce general principles, notrulings that are to be enforced at all times and places. For them, the real testfor any legal system is its practical implementation in the community ofbelievers. The applicability of Islamic law in modern times needs to beexplored in the light of its relevancy in the context of the contemporaryreality of nation-states which insists on the equality of all citizens regardlessof their religious and ethnic affiliations. Many scholars also argue thathermeneutical principles within iğtihād allow for a different and morevibrant interpretation of the Islamic message.
