Abstract

Organized crime is one of the most important transnational social harms that threaten human societies in the current era. This crime is committed by criminal groups that have 3 or more members and usually have a hierarchy, division of labors and continuous criminal activities to achieve an ultimate goal that is obtaining a financial benefit, and the last feature distinguishes these types of activities from terrorist ones. The wordings of the legislator in Article 130, 1392 of Islamic Penal Code support the view that to consider a person as the Leader of a criminal group, a crime must happen but not necessarily by the Leader. Three members is necessary to form a criminal group from the moment the criminal group is formed until the crime is committed. If the Leader commits criminal behavior according to the purposes of the group, then the punishment of the Leader shall be determined according to the rule of multiplicity of the offenses.
