Abstract

Custody and maintenance law of children is one of the biggest challenges when couples divorce, such as, the couples reach an agreement on Custody and maintenance of children is the joint before going to court for divorce, Therefore, in this paper, we try to elaboration the Iranian judicial policy toward the contracts, In the period before and after the adoption of the Family Protection Act 2013, , And will respond to this question Whether the legislator respected the rights that each parent has surrendered in order to receive Custody? in order, first of all we examined The legitimacy of these agreements are legally and then their nature And at the end of the all, agreement enforcement disturb. It seems that the legislator has ignored its former practice and the courts can disrupt agreements based on the best interests of the child.
