Abstract

 The research entitled: “Motivation and Factors Contributing to THE ACCUSED Escape and Ways of Preventing it in Tehran Province” was conducted compared with the first half of years 2005 and 2006. The factors contributing to THE ACCUSED escape was examined and some proper approaches were offered to reduce this phenomenon. The research was of survey type, and after determination of the statistical community and sample population data was collected through using questionnaire technique and studying the failures, which occurred.The philosophy behind selecting this statistical community is that it includes some experts, some of the heads of the police departments in Tehran province, commanders of criminal investigation departments, commanders of DETENTION HOUSEs, escort police forces who were fully aware of all the issues related to THE ACCUSED escape from DETENTION HOUSEs. The results of the research indicate that among the 8 major indices and the 44 earlier-mentioned factors in the research questionnaire, the most important factors that contribute to THE ACCUSED escape were as follows: 1- THE ACCUSED could escape due to not applying security principles by the person in charge of DETENTION HOUSE. 2- Lack of a protected yard suitable for seizing THE ACCUSED. 3- Lack of a secure DETENTION HOUSE. 4- Escort police forces who are not equipped with enough equipment. 5- Police forces which do not escort THE ACCUSED properly. 6- Transportation of THE ACCUSED in unroofed vehicles. 7- THE ACCUSED relatives’ get to know about their transfer. 8- Unlocking THE ACCUSED handcuff during escort. 9- THE ACCUSED visit with his/her relatives during escort. 10-Lack of an experienced colleague to watch THE ACCUSED in the court, etc.11-Police forces that are not well trained. 12- Using only police forces who are attending military service for escorting THE ACCUSED. 13- THE ACCUSED awareness of the existing weaknesses in the arrangements.14- Letting the prohibited objects enter the DETENTION HOUSE. The least important factors contributing to THE ACCUSED escape were: 1- THE ACCUSED mainly initiate artificial row and encounter to escape.2- Mostly, THE ACCUSED escape through collusion with the escort police forces.
