Abstract

Stem cells beside of therapeutic cloning has evaluated medical world as the core of this new way. On the other hand appearance new thoughts about using these technologies has caused challenges among ethical, religious and legal thinkers specially about issues such as legally boundary of a human who has dignity and an embryo who has been created by cloning, awful and un awful to destroy a serie of cells that has been created by therapeutic cloning. All these challenged has led to accepting extract stem cells at a specific stage of fertilized egg division and not recognize moral status for this new being at this stage. But some disagree this new amazing therapeutic way and argue that a fertilized leg has a right to life from the first stage cell division due to have potential for living. Finally, legislative policy is based on ethical and religious teachings in different society.In this article we try to describe relevant medical and ethical issues, and achieving to a verdict related to the case based on jurisprudential fundamentals like other verdicts in the law. A verdict that its loss in law is mentioned in constitution and is about HUMAN LIFE, importance of clone for saving lives of incurable patients and has no contraction with general disciplined ethics.
